AG says infringing some constitutional rights necessary to fight crime

Attorney General Marlene Malahoo-Forte has stated that the constitutional rights of Jamaicans will have to be infringed in order to effectively battle crime.

The Attorney General made the declaration during the 2016 Sectoral Debate in Parliament.

According to Malahoo-Forte, some fundamental rights of Jamaica’s may have to be infringed upon to battle crime as “these are not normal times.”

Some of the changes proposed by the Attorney General include, mandatory no bail for those accused of murder, unless self defence arises on the Crown’s case and the likelihood of acquittal is high. Also the abolishing of trial by jury trial for non-capital murder cases.

The Attorney General called for amendments to be made to several pieces of legislation including The Bail Act, The Criminal Justice Administration Act, The Jury Act, The Evidence Act, The Criminal Justice Plea Negotiation and Agreement Act, The Firearms Act, and The Offence Against the Person Act.
