A Jamaican born-Canadian fugitive has filed legal action against Jamaica’s Minister of Justice, Delroy Chuck, for breaching his constitutional rights.

Flowers was ordered extradited by a Jamaican court in 2014, but later challenged the ruling.

Last year Justice Minister Delroy Chuck signed a extradition order, paving the way for Flowers to be delivered to Canadian authorities, a move his legal team claims violated his constitutional rights.

According to Flower’s legal team their client should be released because Jamaica does not have a corresponding law for the offense for which he is being extradited. They claim that the act does not equate to the offense of inflicting assault occasioning grievous bodily harm.

Flowers also challenged his extradition claiming that being forced to disclose his HIV status would equate to a breach of his Constitutional right to privacy.
